Booking & User Conditions

The following Terms and Conditions (TCs) regulate the contractual relationship and agreement between you as the person using the facilities of this website (hereinafter referred to as the ‘Client’) and/or Agent Elect Business Management Services (hereinafter referred to as ‘Agent Elect’).  When you access, browse or use this website, or the services of Agent Elect, you accept without limitation, the TCs laid out herein.

The website is for your personal use and accordingly, you shall not distribute, modify, sell or transmit anything you copy from the website including (but not limited to) any copy, images, audio or video to use on a commercial or public basis whatsoever.

Agent Elect specialises in travel and lifestyle management services and in their capacity  as a broker, acts as a consolidator  to bring to the Client, the related individual products and services of service providers, suppliers and any additional third parties.   Accordingly, all contracts are concluded between the Client and the service provider, supplier or any additional third party in relationship to the specific product or service the Client wishes to purchase and accordingly, the relative  terms of conditions of such service provider, supplier or additional third party shall apply to which you, the Client  agree to adhere to.

Whilst Agent Elect endeavour to use only reputable partners, Agent Elect are not the company providing the final products and services but act on account of and on behalf of the service provider, supplier or any additional third party and as such, cannot influence the service provider, supplier or any additional third party directly.  Agent Elect is not obliged to verify the statements nor the terms and conditions made by the service provider, supplier or any additional  third party and vis-à-vis to the Client for the correctness of the statements made by its prospective contract partner (service provider, supplier or any third party).  Details of individual service providers, suppliers and any additional third parties terms and conditions are available through Agent Elect’s head office.

Additionally,  the contract concluded between the Client and Agent Elect is a brokerage contract and therefore the following TCs shall apply exclusively to Agent Elect’s brokerage activities and shall have no influence whatsoever on the terms and conditions in place by the individual service provider, supplier or any additional third party.

Only the following TCs apply to the brokerage contract between Agent Elect and the Client:

 A binding Client booking order comes into effect when the Client clicks the button ‘Send Order’ ‘Order’, ‘Book Flights’,  ‘Buy Ticket’,  ‘Book Hotel’, or when an email is received from the Client authorising Agent Elect to go ahead with a booking order in reference and agreement to the specific description of the product or service they wish to purchase.  This will be taken as confirmation of understanding and therefore full authorisation for Agent Elect to go ahead with the booking and for Agent Elect to broker the service or product on behalf of the Client with the service provider, supplier or any additional third party providing this specific service or product.  In principle, a binding confirmation in the form of any invoice, constitutes acceptance with the consequence that the money owed accordingly is due for payment in accordance with the terms and conditions for payment and collateral procedure as laid out by the relevant service provider, supplier or any additional third party and accordingly it is their obligation to render the booking services and/or products and not that of Agent Elect as the Client’s  broker.

By agreeing to the booking, the Client making the booking confirms that he/she is of a legal age and legally entitled to enter into contracts and accordingly, understand  it to be an offer to contract a service or product with a service provider, supplier or any additional third party as selected and booked by the Client.  Accordingly, the Client making the booking, understands and guarantees that they have authority to accept the terms & conditions laid out herein and on behalf of  any other person(s) who may be part of the booking and must verify all booking details to be correct at the time of making the booking and will be responsible for the accuracy of details.  Any costs incurred due to incorrect information provided on the booking, shall be borne by the Client and notification of errors received too late may not allow the Client to withdraw from the contract.  Agent Elect reserve the right to cancel a booking order at the Client’s expense if the incorrect information has been provided.

The Client should contact Agent Elect immediately if they have not received confirmation or documentation of their booking within the given time period.   Should the Client fail to do so and they cannot proceed with their travel arrangements (due to incomplete documentation), then this will be considered  a cancellation and will accordingly be liable for payment of any fees or expenses owing or incurred.

Cancellations or changes to a booking  are in accordance to the service providers, suppliers or any additional third parties  own terms & conditions  and cannot be influenced by Agent Elect.  Normally cancellation and change fees are applicable from the service provider, supplier or any additional third party as well as administration fees from Agent Elect.  In some instances, depending on the terms & conditions of the specific booking, cancellations or changes may not be permitted.

Agent Elect, the service provider, supplier or any additional third party have the right to cancel any booking or parts of the booking or reservation with immediate effect and without prior notice if (a) the payment has not been made for the service or products required by the Client (b) the Client making the booking is not legally entitled to enter into a contract or is not of the legal age to do so.

If payment rendered by the Client is in the form of credit card, the debit posting to the credit card account of the Client, constitutes the acceptance of a binding  booking order. If payment is rendered by the Client in the form of bank transfer, the receipt of monies being transferred to the relevant Agent Elect bank account constitutes the acceptance of a binding booking order or if by cash, by the receipt of cash paid and received at the Agent Elect office.

Brokerage is deemed to be completed when the travel documents have been sent to the Client who upon receiving them, will be responsible to check that all documents are correct and to accordingly notify Agent Elect immediately if discrepancies or errors are found.

In principle, the Client and any person that may be named by the Client as payment debtor, are obliged to make payment for the services or products as stated in the invoice, inclusive of any processing or additional service/administration fees.  Agent Elect reserves the right to cancel any booking when full payment has not been received on time and accordingly, pass on any cancellation fees or additional charges that may occur due to the cancellation onto the Client. There is no obligation whatsoever for Agent Elect to issue tickets, vouchers or any other documentation until payment has been received in full and in all cases, the Client still remains responsible and is obliged to pay the  agreed amounts for the  products or services booked.

Re-booking, Cancellation of Products & Services

A product or service that has been ordered and confirmed may be re-booked only by means of withdrawal from this product or service and the simultaneous order of another product or service.  All monies and expenses incurred for rebooking, are regulated by the terms and conditions of the applicable service provider, supplier or any additional third party.   Any service fees in place at the time of a booking are not refundable if the product or service is re-booked, additional service fees for such amendments/rebookings will also be applicable.

The option of being able to cancel a product or service once it has been ordered and confirmed is determined exclusively by the contracts or terms and conditions of the applicable service provider, supplier or any additional third party and cannot be influenced by Agent Elect and accordingly, it is possible that in some cases, there will be no reimbursement whatsoever in relationship to the contract, terms and conditions of the particular service provider, supplier or any additional third party.  Applicable terms and conditions can be obtained through Agent Elect’s head office.

All re-booking or cancellation requests must be made in writing via email directly to Agent Elect.  The request time is the time of receipt during normal office hours which are 9-6pm Saturday – Thursday, exclusive of all national holidays.  Requests not received during office  hours will be acknowledged from the next working hour (as highlighted above).   Agent Elect are not liable and will not take responsibility for requests to rebook or cancel products and services when receiving them falls out of the restriction of the time frame given or terms and conditions set out by the applicable service provider, supplier or any additional third party.   The Client will remain responsible for any subsequent penalties or consequences that may arise in order  to do so.

Changes, Amendments or Updates to Products & Services

It may become necessary at times for the service provider, supplier or any additional third party to change, amend or update the description of their product or service.  This could be due to unforeseen circumstances, situations beyond their control or to protect the best interest of the Client and the service provider, supplier or any additional third party, reserve the right to make such changes when deemed necessary.  This can include but is not limited to changing airline, airplane, flight schedule, adding stopovers/transfers on non-stop flights, hotels, resorts, venues, tours.  Accordingly, Agent Elect as a broker, hold no liability for such changes and also, whilst every necessary effort is made to ensure that the information provided on this website is given in good faith and is correct, ultimately, details of services and products are provided by the service provider,  supplier or  additional third party and Agent Elect does not guarantee that the information provided is without errors or inaccuracies and as such,  can provide no warranties nor hold any liability for the accuracy, completeness, correctness of the information or timeliness thereof of  such product and services.

Based on conditions beyond the control of Agent Elect, prices may also be changed by the service provider, supplier or any additional third party.  For instance fuel charges, airport taxes and such changes of price are part of the general conditions of the service provider, suppliers or any additional third party.

Travel Procedures & Documentation

In principle, the Client is personally responsible for ensuring that they comply with all the necessary requirements for their travel and that all provisions of law regarding entry into and exit from all relevant countries, health regulations, passport and visa regulations are observed – the same applies to procuring required travel documents.   Please note that regulations can be changed by authorities at any time and we therefore highly recommend obtaining the most up to date information directly from the applicable organisations, consulate or embassy.  Failure to do so, may result in travel being denied and cancellations of bookings being enforced and fees being implemented (as clearly stated in the booking conditions of the service provider, supplier or any third party) plus any additional administrative costs which will be the complete responsibility of the Client.  Agent Elect hold no liability whatsoever for the Client not obtaining the correct travel documentation and any consequences that may arise accordingly.

Agent Elect do not assume liability for any damages that result from the failure of the Client to obtain reconfirmation of their flights or details regarding change of flight timings or cancellations of flights or baggage allowances or any other updates and strongly recommend that the Client liaise directly with the airline accordingly for updates and their latest rules and regulations.

Likewise, Agent Elect provide flights to destinations which may involve greater risks than others.  We strongly advise that travel prohibitions, warnings, announcements are evaluated before travelling.   To travel to such destinations will be the ultimate decision of the Client and accordingly, the Client entirely agrees to do so at their own risk fully understanding that Agent Elect will not be held responsible for any consequences that may occur.

Agent Elect strongly recommend that the Client always secures adequate travel insurance which provides comprehensive coverage before travelling.

Dealing with Unforeseen Scenarios

We ask if anything is not going to plan, you report it directly and immediately to the service provider, supplier or any additional third party and if applicable the local Agent Elect representative that you would have been provided contact details of at the time of receiving  your travel documents and Agent Elect.   Most minor issues can be dealt with straight away and at site.  However, if the service provider, supplier or any additional third party are not made aware of there being a problem or scenario at the time of it taking place, they are not in the position to rectify it and accordingly, Agent Elect are also not in the position to assist or investigate any further.  Please note that we are unable to get involved in issues that may occur through a service or product that has not been purchased or recommended through Agent Elect.

Force Majeure

Agent Elect, the service provider, supplier or any additional third party cannot be held responsible or reliable for any acts of ‘Force Majeure’.  Force Majeure is defined by unusual and unforeseeable circumstances that arise and are out of control of Agent Elect, the service provider, supplier or any additional third party.  Such acts of Force Majeure could be  but are not limited to –  war, threat of war, civil war, riots, strife, terrorist acts (actual or threatened) industrial disputes, technical problems with transport, machinery or equipment, power failure, changes imposed by rescheduling or cancellation of flights by the airline, natural and nuclear disasters, floods, droughts, adverse weather conditions, epidemics, outbreaks of illness.

This website may contain hyperlinks which lead to other websites.  Agent Elect cannot be held responsible for the protection and privacy of any information which you may provide whilst visiting such sites.  Agent Elect has no influence on the design or the contents of such websites and therefore does not warrant that the information presented there is correct, up to date, complete or be the opinions or views held by   Agent Elect.

Interrupted Access of Website

The use of this website is provided on the basis as set out in abovementioned TCs.  It may be that on occasions  the Client have interrupted access or use of this website based on factors outside of Agent Elect’s reasonable control including but not limited to, the unavailability, inoperability or interruption of the Internet or other telecommunication services.  Agent Elect are not liable for any loss or damage whatsoever arising from the inability to access the website.

 Updates to Terms and Conditions (TCs)

Agent Elect reserves the right to change or revise these TCs at any time without being obliged to give advance notice.
